Amy Endicott

Founder

Amy is an independent arbitrator and author based in California’s dynamic Bay Area.  She has over 15 years of experience resolving complex cross-border disputes in aerospace, electronics, and energy infrastructure.  Formerly an equity partner at Arnold & Porter LLP, Ms. Endicott has served as counsel in numerous arbitrations under the ICC, UNCITRAL, ICDR, and ICSID rules. She is a graduate of the ICC’s Advanced Arbitration Academy and a member of CIArb Guidelines Committee on Artificial Intelligence.

How it all started . . . 

In 2023, Amy was co-hosting a fireside chat for law students and posed the following hypothetical: would you rather have an algorithm or a human decide your custody case? All but two students opted for the human.  I changed the hypothetical and asked them to assume that the human arbiter had slept poorly on an old shoulder injury the night before, and had been stuck in traffic on the way to the hearing room, only to find their preferred parking spot taken.  What's more the student had to assume they had been assigned  the last morning hearing slot and when the student walked into the hearing room they looked just like the arbiter's former romantic interest who had deserted the arbiter in a time of crisis.  Now, I asked the students, would you rather have the human or the algorithm decide your case?  The students still wanted the human.  The goal of the Law Human project is to delve into understanding why.  That way, possibly, we can craft a future where machine-assisted legal systems are seen as legitimate, trustworthy, fair, and impartial.
